Minimum Advertised Pricing Policy
As a leading Natural Dog & Cat Food & Treat Company in the United States and Canada under the PureBites and PureSnacks brands, Pure Treats Inc. is focused on ensuring our Retailers and Distributors (collectively, Partners) can be economically successful. In recognition of the investment required for our Partners to provide the level of customer service expected by our loyal end consumers (Pet Parents), Pure Treats is committed to enforcing policies which allow our Partners to maintain profit margins through the sale of our products and to maintain our premium brand status. Pure Treats has established a Minimum Advertised Price Policy (MAPP) that a Partner must follow for the advertised pricing of Pure Treats products. All Pure Treats Partners in the United States and Canada must adhere to the terms and conditions of the following MAPP.
Pure Treats MAPP Guidelines
MAPP pricing for all Pure Treats products can be provided by your Pure Treats sales or distributor rep at any time and will published on the PureBites digital catalog (United States can be found here, Canada can be found here). All advertised prices must be at or above MAPP for all Pure Treats products if a MAPP price has been established by Pure Treats. Partners are not required to list prices in advertising. If a price is listed in an advertisement, it must be at or above MAPP. Other statements such as "call for price" or "call for quote" are acceptable and permitted.
Partners are also responsible for ensuring their Pure Treats advertised pricing is at or above MAPP where advertised on internet search engines. Partners are free to set the advertised price of any product as long as it is at or above the MAPP price in the most recent publication of the Pure Treats price list. Pure Treats' MAPP for all products applies to advertising placements, including but not limited to: print ads (inserts, magazines, newspapers, catalogs, mail order catalogs, etc.), broadcast (radio and TV), direct mail, faxes, internet placement with third parties (banner ads, broadcast emails, search result pages, third-party sites), internet placements on Partner's own website, and any flyers, posters or coupons.
This policy applies to advertised prices and not to the price at which the product is sold to the Pet Parent. Partners are free to decide independently whether to comply with this policy and may sell products at any prices they choose. This policy does not seek to control any Partner's actual sales prices and applies only to the advertised prices of the products.
Pricing Statements
Pure Treats' MAPP does allow Partners to omit pricing entirely from advertisements and/or advertisement statements such as "Call for Price" or "Call for Quote."
Free Offers Associated with Pure Treats Product
Free shipping and/or handling, 0% sales tax, or free financing promotions do not violate the MAPP.
All Pure Treats Products Price Matching Policies
Price matching policies are acceptable. However, price matching cannot be used as a valid reason for violations of Pure Treats' MAPP. Advertised price must always be at MAPP or higher.
MAP Changes
Pure Treats reserves the right to modify, suspend, or cancel the MAP Policy, or modify any or all MAPs at any time. Pure Treats will provide notice of any such modifications, suspension, or cancellations on the Pure Treats website here. It is the responsibility of each Partner to monitor the PureBites website for updates.
Distributors
All Pure Treats Distributors will:
- Cooperate in the implementation of this MAPP including stopping to ship their customers as required by Pure Treats to ensure compliance with this MAPP.
- Provide sales reports by customer and customer lists to Pure Treats.
Failure to Comply with MAPP
At the sole discretion of Pure Treats, failure to comply with MAPP, intentional and/or repeated failure to abide, may result in the immediate loss of a Partner's ability to purchase all Pure Treats products both directly from Pure Treats or through distribution.
Enforcement of MAPP
Pure Treats will utilize the following steps with the full cooperation of Partners to enforce this MAPP and resolve MAPP violations. Pure Treats does not assume any liability by enforcing MAPP.
Violations by Retailers will need to be corrected within 1 day of notification.
- First Violation: A written warning will be provided. MAPP violations must be corrected within 1 day. Upon correction and following 30 days of compliance, violation will then be cleared.
- Second Violation: Pure Treats products that were identified as violating our MAPP will be put on hold temporarily. MAPP violations must be corrected within 1 day. Upon correction and following 30 days of compliance, violation will then be cleared.
- Third Violation: Pure Treats products that were identified as violating our MAPP will be put on hold for 30 days.
- Fourth Violation: Pure Treats products that were identified as violating our MAPP will be put on hold for 90 days. After this duration Pure Treats will review and determine if these products will be reinstated.
This policy does not constitute an agreement between any Partner and Pure Treats. This policy is administered unilaterally by Pure Treats and is non-negotiable. Interpretation and application of the terms of this policy shall remain within the sole discretion of Pure Treats. Pure Treats will not negotiate with or enter into an agreement with any Partner regarding this Policy or regarding the prices at which the Partner will sell the products. Please note that Pure Treats employees and representatives are not authorized to modify this policy or grant exceptions.
